RC International Disputes is an independent disputes practice, advising, assisting and representing clients in all stages of international disputes before international arbitral tribunals and international courts, across various sectors.
At RC we love any complex dispute, we love the process, each and every small step needed in order to achieve a great result, and we love a successful outcome. But more than that we love to prevent disputes. Saving time and costs, and especially business relations for our clients is the most fulfilling mission we embrace day by day.
Experience showed that the steps taken for dispute prevention are also essential to ensure a better preparation for a potential dispute, because dispute prevention, as well as dispute preparation, start at the moment when a contract is negotiated. Every step, from drafting and negotiating every contractual clause to every correspondence and subsequent document or meeting is part of a successful prevention, but also part of preparing for a successful resolution of a potential dispute.
Preventing Disputes
We advise on prevention of disputes, contract negotiations, pre-dispute strategy, pre-dispute negotiations, and settlement agreements. This includes input on contract drafting with a focus on arbitration clauses, jurisdictional clauses, governing law clauses, expert determination agreements, and the interactions between all of them.
We also advise on EU law matters, Private international law / Conflicts of Laws, Human Rights protection, GDPR compliance, and the full spectrum of corporate advisory.
Managing and Resolving Disputes
We assist and represent clients in international arbitration cases conducted under the major institutional rules, as well as in ad hoc arbitration cases, across a variety of sectors: construction, infrastructure, IT, telecommunications, movie industry, energy, natural resources, commodities, manufacturing, FIDIC contracts, EFET contracts, joint venture agreements, corporate disputes, etc.
We also handle proceedings before the national courts in relation to international arbitration: application for setting aside awards, enforcement of awards, provisional measures, etc.
We represent clients before the Court of Justice of the European Union, and the European Court for Human Rights, as well as before the Romanian Courts, including the High Court of Cassation and Justice, and the Constitutional Court.
